By creating an account, accessing, or using Daily Sunshine (the "Platform"), you confirm that you have read, understood, and agreed to be bound by these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree, you must not register for or use the Platform. Your affirmative consent is recorded at the time of sign-up.
These Terms constitute a legally binding agreement between you ("User", "you") and Daily Sunshine ("we", "us", "the Platform"), its owners, operators, staff, and associates.
You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use the Platform. If you are under 18, you represent that your parent or legal guardian has reviewed and accepted these Terms on your behalf.
You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are solely responsible for all activity under your account and must not share your password or access with others.
Daily Sunshine is a social interaction and positivity companion designed to share uplifting, encouraging messages and to facilitate thoughtful communication between friends and contacts. The Platform is provided for general social, motivational, and entertainment purposes only.
NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE. The content generated, delivered, or shared through the Platform — whether by artificial intelligence, other users, or otherwise — is not medical, mental health, psychological, psychiatric, therapeutic, or clinical advice, and does not constitute a diagnosis, treatment plan, prescription, or any form of professional healthcare. The Platform is not a healthcare provider, telehealth service, or clinical intervention of any kind.
You acknowledge that the Platform must never be relied upon as a substitute for the advice of a qualified medical or mental health professional, or for any clinical or emergency situation. If you are experiencing a crisis, mental health emergency, or any health-related concern, you should immediately contact a licensed professional or your local emergency services. The Platform does not monitor user content for safety and assumes no responsibility to do so.
You agree to use the Platform lawfully and respectfully. You will not:
You are solely responsible for all content you create or share. You grant the Platform a worldwide, royalty-free license to host, store, transmit, and display your content solely as needed to operate the Platform.
Daily Sunshine is a community dedicated to kindness, encouragement, and positivity. To protect this environment, you agree that you will not create, generate, send, schedule, or share through the Platform any content that is hateful, abusive, insulting, derogatory, degrading, shaming, harassing, threatening, defamatory, discriminatory, or that otherwise attacks, demeans, or disparages any person or group.
The Platform employs automated moderation — including keyword filtering and artificial-intelligence-based content analysis — to screen user-submitted and AI-generated messages before they are stored, delivered, or shared. Any message determined to violate this Content Policy is blocked and not published.
Each blocked attempt is logged as a violation associated with your account. Upon a second or subsequent violation of this Content Policy, an automated alert is escalated to the Platform's administrators, together with evidentiary detail of the offending content, for review and enforcement action.
Penalties. Violation of this Content Policy constitutes a material breach of these Terms. Penalties include, without limitation: immediate blocking of the offending content; warnings; temporary suspension of account access; and, in the case of repeated or serious violations, permanent blacklisting of your account and permanent removal of your access to the Platform, without refund of any subscription fees paid. Blacklisted accounts are prohibited from re-registering or accessing the Platform in any form.
The Platform reserves the right to determine, in its sole discretion, whether content violates this Policy and to take any enforcement action it deems appropriate, including immediate permanent blacklisting without prior warning for serious or repeated violations. Where conduct is unlawful, the Platform may refer the matter to the relevant authorities.
This Content Policy is in addition to, and does not limit, the general conduct obligations and penalties set out elsewhere in these Terms.
Daily Sunshine offers a subscription model. New users receive a 30-day free trial, after which paid plans are available (currently $4.99/month or $47.90/year). Pricing may change with reasonable notice.
By subscribing, you authorize us to charge the applicable fees to your selected payment method via our payment processor (Stripe). Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date. You may cancel at any time; cancellation stops future renewals but does not refund the current paid period.
Discount or promotion codes, where offered, are subject to their stated terms, may have redemption limits or expiry dates, and may be modified or revoked at any time. Abuse, fraud, or manipulation of discount or referral systems results in immediate forfeiture of any reward and may lead to account termination.
Fees are non-refundable except where required by law. Taxes, where applicable, are your responsibility.
The Platform may offer a referral program (for example, inviting 5 friends who join earns a period of free Premium). Referral rewards are granted only when invitees genuinely join and remain in good standing. We reserve the right to revoke rewards, adjust thresholds, or discontinue the program at any time, and to void rewards obtained through fraudulent, self-referral, or abusive means.
You commit to using the Platform in good faith, to respecting other users, to honoring your payment obligations, and to promptly notifying us of any unauthorized use of your account or any billing discrepancy. You agree to comply with all applicable local, national, and international laws.
Violation of these Terms, failure to meet payment obligations, fraudulent activity, or abuse of Platform resources may result in penalties including, without limitation: suspension or permanent termination of your account; forfeiture of subscription fees, trial access, referral rewards, and discount entitlements; blocking of future access; and where applicable, referral to the relevant authorities or legal action to recover losses, damages, and costs.
We reserve the right to take any lawful action necessary to protect the Platform and its community, and to pursue all available remedies against defaulters.
The Platform, its name, logo, design, software, and original content are the property of Daily Sunshine and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Platform without authorization. AI-generated content is provided for your personal, non-commercial use.
The Platform integrates with third-party services (including payment processing, email delivery, and AI providers). We are not responsible for the acts, omissions, or availability of these third parties. Your use of such services is subject to their respective terms and policies.
The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error-free, secure, or that any content is accurate, appropriate, or beneficial.
To the maximum extent permitted by law, Daily Sunshine, its owners, staff, and associates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of, or inability to use, the Platform.
You agree to fully indemnify, defend, and hold harmless Daily Sunshine, its owners, operators, staff, employees, contractors, agents, affiliates, and associates (collectively, the "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, and expenses — including reasonable legal fees — arising out of or in any way connected with: your use of the Platform; your violation of these Terms; your violation of any law or third-party rights; any content you submit or share; or any breach of your payment or conduct obligations.
This indemnity applies regardless of any negligence or fault by any Indemnified Party, to the fullest extent permitted by law, and survives the termination of your account or these Terms.
We may suspend or terminate your account and access at any time, with or without cause or notice, including for violations of these Terms. You may stop using the Platform and cancel your subscription at any time. All provisions which by their nature should survive termination shall remain in effect.
We may update these Terms from time to time. Material changes will be communicated with reasonable notice. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the jurisdiction in which the Platform operates, without regard to conflict-of-law principles. Any dispute shall first be attempted to be resolved through good-faith negotiation, and where unresolved, through binding arbitration or the competent courts of the applicable jurisdiction.
